Child Custody Rights in Pakistan: How Courts Decide
Custody disputes are emotional, but courts focus on one central question: what serves the welfare of the child.
Custody and guardianship are different
Custody (hizanat) relates to the day-to-day care of the child, while guardianship relates to legal authority over the child’s person and property. These are treated separately, and different people may hold each role.
The welfare of the child comes first
Pakistani courts treat the welfare of the minor as the paramount consideration, rather than the rights of either parent. Factors can include the age and needs of the child, the home environment, stability, education and the ability of each parent to provide care.
The mother’s role
Under personal law principles applied by courts, mothers are commonly given priority in the care of young children, subject to the court’s assessment of the child’s welfare and any circumstances that affect it.
The father’s role and visitation
Fathers are generally natural guardians, and courts can arrange meetings or visitation so that the child keeps contact with both parents. Terms depend on the case.

Does the child’s wish matter?
A court may consider the preference of an older child as one factor, but it is not decisive on its own.
