Khula Procedure in Pakistan: A Step-by-Step Guide
Khula is the legal route by which a wife can seek dissolution of marriage through the family court. This guide walks through the usual steps in plain language.
What is khula?
Khula is a form of dissolution of marriage initiated by the wife, in which she asks the court to end the marriage, usually by returning or giving up some or all of the benefits received at marriage. It is decided by the family court under the applicable family laws of Pakistan.
Step 1: Preparing and filing the suit
A suit for dissolution of marriage on the basis of khula is filed before the Family Court having jurisdiction. The plaint typically includes details of the marriage, the reasons the marriage cannot continue, and the relief sought. Supporting documents such as the nikah nama and CNICs are attached.
Step 2: Notice to the husband
The court issues notice to the husband to appear and respond. Service of notice is an important stage, and delays often arise here, so keeping the husband’s correct address available helps.
Step 3: Reconciliation attempts
Family courts are required to try to reconcile the parties at the pre-trial stage. If reconciliation does not succeed, the proceedings move forward.
Step 4: Evidence and decree
Where the court is satisfied that the parties cannot live within the limits set by Allah, it may pass a decree dissolving the marriage. Financial aspects such as dower, maintenance and dowry articles are dealt with according to the facts and claims raised. Our khula and divorce lawyer page explains how we support clients through this.
After the decree
After the decree, steps such as union council notice and registration formalities may follow. Matters such as custody and maintenance of children are handled separately; see our guide to child custody and guardianship.
